General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (“Terms”) apply to all orders placed by consumers through the Vita Natura Fit online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession within the meaning of Section 13 of the German Civil Code (BGB).

3. Conclusion of the Contract

The presentation of products in our online shop does not constitute a legally binding offer. It constitutes an invitation to the customer to place an order.

By clicking the final purchase button, you submit a binding order for the products contained in your shopping cart.

After your order has been submitted, you will receive an automated confirmation by email acknowledging receipt of your order. This confirmation of receipt does not, by itself, constitute acceptance of your order.

The purchase contract is concluded when we accept your order by sending you a shipping confirmation or by dispatching the ordered goods.

4. Prices and Shipping Costs

All prices displayed in our online shop are stated in euros and include applicable statutory VAT, unless otherwise indicated.

Any additional shipping costs will be clearly displayed during the checkout process before you submit your order.

5. Payment

Depending on availability at checkout, we may offer the following payment methods:

The payment methods available for your particular order will be displayed during checkout.

6. Delivery

We deliver within Germany and to selected countries within the European Union.

The countries currently available for delivery, together with any applicable shipping charges, will be displayed during the ordering process.

Unless otherwise stated for a particular product or destination, the estimated delivery time is generally 2–5 business days after receipt of payment.

If an ordered product is unavailable or if delivery is unexpectedly delayed, we will inform you as soon as reasonably possible.

7. Important Information About Food Supplements

The products offered by Vita Natura Fit are food supplements.

Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle.

Do not exceed the recommended daily intake stated on the product label.

Keep food supplements out of the reach of young children.

Customers with known allergies or intolerances, existing medical conditions, or those who are taking medication should seek appropriate medical advice before using a food supplement where necessary.

Please always follow the directions and information provided on the individual product label.

8. Right of Withdrawal

Consumers generally have a statutory right to withdraw from a distance contract within 14 days, subject to the applicable legal requirements and exceptions.

Full information concerning the right of withdrawal, the withdrawal period, and the procedure for exercising this right is provided in our separate Withdrawal Policy available on our website.

The right of withdrawal does not apply, among other statutory exceptions, to sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery.

Your statutory rights remain unaffected.

9. Retention of Title

The goods remain our property until the purchase price has been paid in full.

10. Liability

We are liable without limitation for damage caused intentionally or through gross negligence.

In cases of ordinary negligence, we are liable for damage resulting from injury to life, body, or health.

We are also liable for the negligent breach of essential contractual obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer may reasonably rely. In such cases, liability is limited to damage that was foreseeable and typical for the contract, to the extent permitted by applicable law.

Any further liability is excluded to the extent permitted by law.

Mandatory statutory liability provisions remain unaffected.

11. Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration or conciliation body, unless a legal obligation to participate applies.

12. Applicable Law

These Terms and the contractual relationship between Vita Natura Fit GMBh and the customer are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer and have your habitual residence in another country, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law that would apply to you in the absence of this choice of law.

13. Severability

If any provision of these Terms is or becomes invalid, unenforceable, or ineffective, the validity of the remaining provisions shall remain unaffected.

Mandatory statutory provisions shall apply in place of any invalid or unenforceable provision.
